Terms of Service — Ave Signal

1. Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of the website avesignal.com and the Ave Signal market intelligence terminal (collectively, the "Service"), operated by Ave Signal ("we," "us," "our"). By creating an account, subscribing, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years old and legally able to enter into a binding contract to use the Service. By using Ave Signal, you represent that you meet these requirements and that you are not barred from using the Service under the laws of your jurisdiction.

3. The Service

Ave Signal provides a real-time market intelligence terminal aggregating data across crypto, equities, forex, and commodities. The Service includes signals, heatmaps, whale tracking, macro intelligence, and AI-assisted analysis tools. Specific features depend on the subscription tier (Legionary, Centurion, General, Caesar Imperator, or Founding Member).

The Service is an informational tool only. Ave Signal does not provide personalized financial, investment, legal, or tax advice. Nothing displayed on the platform constitutes a recommendation to buy, sell, or hold any asset.

4. Account Registration

To access most features, you must create an account. You agree to:

Provide accurate, current, and complete information
Maintain the confidentiality of your password
Be solely responsible for all activity under your account
Notify us immediately at support@avesignal.com of any unauthorized access

One person may not maintain multiple accounts. We may suspend or terminate accounts that violate these Terms.

5. Subscriptions and Payments

5.1 Plans

The Service offers multiple subscription tiers:

Legionary — 24-hour free trial, no payment required, limited features
Centurion — recurring monthly or annual subscription
General — recurring monthly or annual subscription
Caesar Imperator — recurring monthly or annual subscription
Founding Member — one-time payment for lifetime General access (limited to first 500 customers or 72 hours from launch, whichever comes first)

Current pricing is shown on the Pricing page and may change with notice.

5.2 Billing

Payments are processed by Stripe. By subscribing, you authorize recurring charges to your payment method until you cancel. Subscriptions automatically renew at the end of each billing period at the then-current rate.

5.3 Cancellation

You may cancel at any time from your account settings. Cancellation stops future renewals; access continues until the end of the current billing period. No pro-rated refunds are provided for partial periods.

5.4 Refunds

No refunds are issued after 24 hours of first access. By activating any subscription or Founding Member lifetime access, you acknowledge that the Service delivers immediate digital value — live signals, AI requests, whale tracking, and data access — from the moment of first login. All sales are final once 24 hours have elapsed from first access.

All recurring plans (Centurion, General, Caesar Imperator): no refund after 24h of first use.
Founding Member ($399 one-time): no refund after 24h of first access.
AI Trading Packs (add-ons): non-refundable once any request has been consumed.
Legionary (24h free trial): no charge applies.

5.5 Founding Member Terms

"Lifetime" access for Founding Members means continuous General-level access for as long as Ave Signal operates the Service. If the Service is discontinued or sold, we will provide reasonable notice but cannot guarantee perpetual continuation. Founding Member access does NOT include Caesar Imperator tier benefits and may not be transferred to another account.

5.6 Price Changes

We may change subscription prices with at least 30 days' notice via email. Price changes do not apply to Founding Members for their lifetime access at the General level (Caesar Imperator add-on prices may change).

6. Acceptable Use

You agree NOT to:

Use the Service for any unlawful purpose or in violation of any applicable laws
Resell, redistribute, or commercially exploit any data or signals from the Service without our written permission
Scrape, mirror, or extract data via automated means (bots, crawlers, etc.)
Reverse-engineer, decompile, or attempt to extract source code
Share your account credentials with others
Use the Service to harass, defame, or harm others
Interfere with or disrupt the Service or its infrastructure
Use the Service to manipulate markets or engage in coordinated trading schemes

Violations may result in immediate suspension or termination without refund.

7. Intellectual Property

The Service, including its software, design, signals methodology, branding (Ave Signal, Imperium, Legionary/Centurion/General/Caesar Imperator tier names), text, graphics, and all derivative works, is owned by Ave Signal and protected by intellectual property laws.

You receive a limited, non-exclusive, non-transferable, revocable license to use the Service for personal trading research purposes only. You may not reproduce, modify, distribute, or create derivative works without our written permission.

8. Third-Party Data and Services

The Service aggregates data from third-party sources (exchanges, market data providers, news APIs). We do not guarantee the accuracy, completeness, or timeliness of third-party data. Data feeds may be delayed, interrupted, or incorrect. See our Data Sources page for transparency on what we currently use.

9. AI-Generated Content

AI Trading Requests and AI Signals are generated by automated systems analyzing market data. AI outputs may contain errors, biases, or hallucinations. They are NOT financial advice. You bear sole responsibility for any decisions based on AI outputs.

10. No Financial Advice — IMPORTANT

Ave Signal is NOT a registered investment advisor, broker-dealer, or financial planner. The Service provides information and analytical tools only. Nothing displayed, sent via email, shown in signals, generated by AI, or otherwise communicated through the Service is financial advice, investment advice, or a recommendation to take any specific action.

Trading and investing in financial markets carries substantial risk. You may lose part or all of your capital. Past performance does not guarantee future results. You should consult with a licensed financial advisor before making any investment decision.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED OPERATION.

We do not warrant that the Service will be error-free, secure, or continuously available, or that any data, signal, or AI output will be accurate or profitable.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AVE SIGNAL, ITS OPERATORS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, TRADING LOSSES, LOSS OF DATA, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF THE SERVICE.

Our total cumulative liability for any claim arising from these Terms or the Service shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) USD $100.

Some jurisdictions do not allow limitations on implied warranties or consequential damages, so some of the above may not apply to you.

13. Indemnification

You agree to indemnify and hold harmless Ave Signal from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of third parties.

14. Termination

You may terminate your account at any time from settings or by emailing support@avesignal.com. We may suspend or terminate your access at any time for violation of these Terms, suspected fraud, or operational reasons, with or without notice.

Upon termination, your right to use the Service ends. Sections that by their nature should survive termination (intellectual property, disclaimers, limitation of liability, indemnification, governing law) shall survive.

15. Modifications to the Terms

We may update these Terms from time to time. Material changes will be communicated via email to registered users at least 30 days before they take effect. Continued use of the Service after changes means you accept the updated Terms.

16. Governing Law

These Terms are governed by the laws of the jurisdiction in which Ave Signal is operated, without regard to conflict-of-law principles. Any disputes shall be resolved in the competent courts of that jurisdiction, except where mandatory consumer protection law in your country of residence applies.

17. Dispute Resolution

Before initiating any legal action, you agree to first contact us at support@avesignal.com and attempt to resolve the dispute informally for at least 30 days.

18. Entire Agreement

These Terms, together with our Privacy Policy, Disclaimer, and Risk Notice, constitute the entire agreement between you and Ave Signal regarding the Service.
